hailadvocate.ca is a directory service that connects homeowners with qualified roofing contractors, specializing in hail damage remediation and insurance claim support. We do not directly provide roofing services.

1. Definitions

2. Use of Service

Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use hailadvocate.ca. By using our Service, you represent that you meet these requirements.

Acceptable Use

You agree to use hailadvocate.ca only for lawful purposes. You may not:

• Provide false, misleading, or fraudulent information in quote requests
• Use the Service to spam, harass, or abuse contractors or other users
• Attempt to circumvent security measures or access restricted areas
• Scrape, data mine, or automatically collect information from the Service

3. Directory and Matching Service

Nature of Service

hailadvocate.ca is an informational directory and lead generation platform. We connect homeowners with contractors but do not:

• Employ or control contractors listed in our directory
• Guarantee the quality, safety, or legality of their work
• Supervise, direct, or control the work performed by contractors
• Act as an agent for contractors or homeowners

Contractor Verification

While we make reasonable efforts to verify contractor credentials, licenses, and insurance, we do not guarantee the accuracy of contractor information. Users are responsible for independently verifying contractor qualifications before engaging their services.

No Endorsement

Listing in our directory does not constitute an endorsement, recommendation, or warranty. Featured or sponsored listings are paid placements and do not indicate superior quality.

4. Quote Requests and Leads

When you submit a quote request:

• Your information will be shared with one or more contractors based on your preferences
• Contractors may contact you via phone, email, or other methods you provide
• You consent to receive communications from contractors regarding your request
• You are not obligated to accept any quotes or hire any contractor
• All agreements and transactions are directly between you and the contractor

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. hailadvocate.ca DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Merchantability and fitness for a particular purpose
• Accuracy, reliability, or completeness of information
• Uninterrupted or error-free operation
• Security of data transmission
• Quality of contractor work or services

We do not warrant that contractors will respond to your requests, provide accurate quotes, or perform work satisfactorily.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, hailadvocate.ca SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Damages arising from contractor work, delays, or negligence
• Loss of profits, revenue, or business opportunities
• Property damage or personal injury caused by contractors
• Insurance claim denials or disputes with contractors
• Data loss or unauthorized access to your information

Our total liability shall not exceed the amount you paid to use the Service in the 12 months preceding the claim, or $100 CAD, whichever is greater.

7. Indemnification

You agree to indemnify, defend, and hold harmless hailadvocate.ca, its officers, directors, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your interactions with contractors
• Any false or misleading information you provide
• Your violation of applicable laws or regulations

9. Your Responsibilities

As a user of hailadvocate.ca, you are responsible for:

• Verifying contractor licenses, insurance, and credentials
• Obtaining and reviewing written contracts before work begins
• Understanding your insurance policy coverage and claim process
• Conducting due diligence on contractors before hiring
• Resolving disputes directly with contractors
• Complying with all applicable laws and regulations

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in Calgary, Alberta, or in the courts of Calgary, Alberta.
